TERMS AND CONDITIONS
1. PREAMBLE
These general terms and conditions govern sales made by Olea Voyages, a simplified joint-stock company with capital of €7,500, whose registered office is located at 134 route des Berguières 06140 Tourrettes sur Loup, registered with the Grasse Trade and Companies Register under number 990 987 463, hereinafter referred to as Olea Voyages.
Olea Voyages is registered with Atout France under number IM006250010, has financial guarantee coverage with GROUPAMA ASSURANCE-CRÉDIT & CAUTION – 8-10 RUE D’ASTORG, 75008 PARIS, France, and professional liability insurance with HISCOX SA – 49 AVENUE DE L’OPÉRA, 75002 PARIS, FRANCE.
For the purposes hereof, “Client” means the natural or legal person who enters into the sales contract with Olea Voyages, makes the booking, and assumes contractual obligations, including payment of the price. “Participant” or “Traveler” means any natural person, including the Client or any third party designated by them, registered for the booking and entitled to benefit from the travel services provided in the contract.
By purchasing the travel services offered by Olea Voyages, the Client accepts these Terms and Conditions in their entirety.
In the event of conflict between the Terms and Conditions and the Contract concluded between the Client and Olea Voyages, the provisions of the Contract shall prevail. These Terms and Conditions supplement the pre-contractual information provided to the Client before conclusion of the contract.
2. BOOKING THE TRIP
Olea Voyages develops a travel proposal taking into account the Client’s wishes and needs. Bookings are entirely tailor-made and personalized. Before booking confirmation, the Client receives an email inviting them to review a proposal detailing the trip. Signing this proposal and paying the indicated amount constitutes acceptance by the Client of the offer. Upon this acceptance, Olea Voyages requests confirmation of services from its partners. Tailor-made trips involve ongoing adjustments; services remain subject to availability and supplier confirmation.
As soon as possible following acceptance, the Client is informed of the trip confirmation status. If a service is unavailable, Olea Voyages will, where possible, propose an alternative that may result in a price adjustment that the Client may accept or refuse. In the absence of an accepted reasonable alternative, amounts paid for unconfirmed services will be refunded; however, irreversible costs incurred at the Client’s request remain the Client’s responsibility (e.g., fares subject to immediate issuance, non-refundable services, handling fees and/or insurance). Prices and availability are only guaranteed from the written booking confirmation sent by Olea Voyages, which serves as proof and forms the contract as of its sending date.
The Client is informed that under consumer law, trips sold by Olea Voyages do not benefit from any right of withdrawal. Any cancellation request falls under the cancellation regime provided in these Terms and Conditions.
3. CLIENT OBLIGATIONS
The Client declares having the capacity to contract and being authorized to commit all Participants to compliance with the Terms and Conditions. They act as the sole point of contact, undertake to settle all amounts due, and receive travel documents to transmit to Participants.
The Client undertakes to provide accurate, complete, and up-to-date information concerning each Participant in the trip (identity strictly conforming to official documents, dates of birth, nationality, contact details, special needs, etc.), verifies names, dates, times, and all trip services before confirmation, and undertakes to transmit travel information provided by Olea Voyages to each Participant, so that Olea Voyages cannot be held responsible for any failure or omission in their transmission.
Any error, omission, or failure to report before confirmation, as well as any correction requested after confirmation, is the sole responsibility of the Client and results in full billing of modification and/or reissue fees from service providers, plus agency fees where applicable. Olea Voyages cannot be held responsible for the consequences of inaccurate or incomplete information. Acceptance of the proposal constitutes confirmation of these commitments and acceptance of the Terms and Conditions.
4. PRICING TERMS
By default, prices are expressed in Euros, including known taxes. They do not include visa fees, vaccinations, tips, local tourist taxes, or personal expenses. If certain costs cannot reasonably be calculated before conclusion of the contract, Olea Voyages will inform the Client, upon booking, of the nature and type of additional fees they may still have to pay.
On an optional basis and without obligation for Olea Voyages, payment in the Client’s currency may be offered when indicated in the commercial proposal to facilitate payment. In this case, the proposal specifies the accepted currency and the exact amount payable in that currency (as well as, where applicable, the validity period of this indication). Payments may be made by bank transfer, debit card, or credit card.
In all cases, a deposit is required to make a booking. Its amount varies depending on the nature of your trip and will be confirmed before booking. The balance is due 8 weeks before the scheduled departure date. If the booking is made less than 8 weeks before departure, the total trip price will be payable upon booking. Your booking confirmation will indicate the balance due date. If, after payment of a deposit upon booking, the balance remains unpaid within 8 weeks of the scheduled departure date, Olea Voyages may, without prior notice or obligation to send reminders, suspend contract execution, not issue travel documents, and consider the booking cancelled. In this case, cancellation fees will apply in accordance with Article 5.3 CANCELLATION of these Terms and Conditions.
After contract conclusion, the package price may be revised to account for variations in passenger transportation costs related to fuel/energy prices, variations in taxes and fees related to services (airport/port taxes, security, boarding/disembarkation), and exchange rates applicable to the package. The calculation basis used is that in effect on the booking confirmation date, and the variation is passed on proportionally to the affected components. Any revision is notified on a durable medium, with calculation details and affected items, and cannot occur less than twenty (20) days before the trip start. In case of an increase of less than 8% of the total price, the supplement is payable within the period indicated in the notification; any failure to pay may be treated as a cancellation by the Client according to the applicable scale. In case of an increase > 8%, the Client may accept the modification or terminate the contract without fees with full refund, without additional compensation.
5. TRANSFER, MODIFICATION AND CANCELLATION AT THE CLIENT'S INITIATIVE
5.1 TRANSFER
In accordance with Article L.211-11 of the Tourism Code, the purchaser may transfer their contract (excluding insurance) to a person meeting all conditions to make the trip, by informing Olea Voyages within a reasonable time and no later than seven days before the trip start.
The transferor and transferee are jointly and severally liable for payment of the balance and any additional fees, charges, or other costs occasioned by this transfer. In this case, Olea Voyages will inform the transferor of the actual transfer costs.
5.2 MODIFICATION
After booking confirmation, any request to modify services (including: dates and times, Participant identity, accommodation categories, ancillary services, etc.) must be submitted in writing by the Client. Olea Voyages may review the request without being obligated to do so, subject to availability and supplier agreement.
It is expressly stated that certain modifications, particularly name and/or date changes on transportation tickets, may be treated by suppliers as a cancellation followed by a new booking, resulting in penalties of up to 100% of the ticket price, to which fare differences, taxes, and additional charges may be added.
Any modification request concerning the departure and/or return date may result in additional fees being charged. Failure to pay modification fees will be considered a cancellation at the Client’s initiative, to which the conditions provided herein will apply.
Any accepted modification will result in:
- Administrative fees of €100 excluding tax per file, in addition;
- Full pass-through of fees, penalties, fare differentials, taxes, and non-refundable costs charged by service providers;
- Where applicable, associated bank charges.
The modification becomes effective only after written acceptance by Olea Voyages and advance payment of all amounts due. When the modification results in a price increase, the Client undertakes to pay the amount; if it leads to a decrease, only amounts recoverable from service providers may, where applicable, be refunded, after deduction of non-refundable fees and administrative fees.
In the absence of modification possibility, or in case of refusal of the proposed modification, the Client may maintain the initial contract or cancel the booking; in the latter case, the cancellation fees provided in Article 5.3 CANCELLATION will apply.
5.3 CANCELLATION
The Client may terminate the contract at any time before the package starts. Termination takes effect on the date Olea Voyages receives written cancellation notification:
- The email must be sent by the Primary Holder from the contact address on file;
- If the request comes from a Participant other than the Primary Holder, Olea Voyages may require written authorization from the Primary Holder.
Cancellation results in billing of appropriate and justifiable termination fees, reflecting costs actually incurred by Olea Voyages due to cancellation (including non-refundable service provider fees).
A cancellation scale is communicated in the trip proposal and confirmed in the contract.
As an indication:
- More than 8 weeks before departure (before balance due date): fees correspond at minimum to the deposit paid (including, where applicable, any increased deposit for scheduled flights) and may be higher if service providers apply additional penalties;
- From the balance due date until departure: fees are generally higher than the deposit and may reach up to 100% of the total price depending on service provider conditions and proximity to departure date.
Cancellation of one Participant (without canceling the rest of the file) is treated as a modification that may result in additional costs to the Client as provided in Article 5.2 MODIFICATION.
We invite the Client to contact Olea Voyages as soon as possible. The estimated amount of cancellation fees can be confirmed upon request at any time, including before booking; the Client is invited to verify this amount before confirming cancellation.
If the cancellation reason is covered by the Client’s insurance, they may request partial or full reimbursement of cancellation fees from their insurer.
In case of refundable amounts, the refund is paid to the Client within fourteen (14) days following cancellation.
6. MODIFICATION AND CANCELLATION AT OLEA VOYAGES' INITIATIVE
6.1 MODIFICATION
Before issuing the booking confirmation, Olea Voyages may need to adapt the proposed trip, without fees or compensation, by informing the Client of any change affecting the booking.
After contract issuance, Olea Voyages is authorized to make minor modifications to the Client’s booking (for example: time adjustments, substitution with equivalent or superior service), subject to prior information, without fees or compensation.
If, before the trip starts, Olea Voyages is forced, due to circumstances beyond its control, to significantly modify an essential element of the trip, Olea Voyages informs the Client as soon as possible. Within the period indicated in this notification, the Client may accept the proposed modifications or terminate the contract without cancellation fees.
If the Client chooses to terminate the contract, they may accept, when possible, a replacement package proposed by Olea Voyages. When modifications accepted by the Client or the replacement package lead to a lower quality or cost level, Olea Voyages grants an appropriate price reduction.
If the Client terminates the contract and does not accept a replacement package, they are entitled to a full refund within fourteen days of termination.
6.2 CANCELLATION
Olea Voyages may terminate the contract, with no compensation other than full refund, in case of exceptional and unavoidable circumstances preventing execution, duly notified before the trip start. Refunds occur as soon as possible and no later than fourteen days.
7. PERFORMANCE, NON-CONFORMITY AND LIABILITY
Olea Voyages is responsible for proper performance of services included in the contract, in accordance with Articles L.211-16 et seq. of the Tourism Code. This responsibility is exercised within the limits of the provisions below.
Olea Voyages cannot be held liable for consequences of:
- Loss or theft of transportation tickets by traveler(s); all resulting costs remain their responsibility;
- Failure to present required administrative and/or health documents to authorities and/or carriers (passport, visa, vaccination certificates, authorizations, means of payment, etc.), in accordance with information provided by Olea Voyages; any boarding/entry refusal or resulting costs remain the traveler’s responsibility;
- Late arrival at check-in and/or boarding for any transportation journey. In this case, any subsequent service that becomes unexecutable is deemed due and non-refundable, and no transportation ticket refund will be owed by Olea Voyages;
- Unforeseeable or unavoidable events of a third party to the contract (within the meaning of the Tourism Code) such as wars, political unrest, strikes, riots, administrative decisions, technical or administrative incidents, airspace congestion, bad weather, delays (including postal), breakdowns, as well as loss/theft of luggage or other personal belongings of travelers;
- Exceptional and unavoidable circumstances justifying trip adaptations or cancellation for security reasons and/or by order of an authority. In this case, Olea Voyages may make modifications (dates, times, itineraries) without right to additional compensation.
In case of non-conformity, the traveler is entitled to a price reduction for any affected period, unless the non-conformity is attributable to the traveler, to a third party external to service provision and unforeseeable or unavoidable, or results from exceptional and unavoidable circumstances.
If Olea Voyages’ liability is engaged, compensation limits provided by international conventions will apply, in accordance with Article L 211-17-IV of the Tourism Code. In any case, except for bodily injury, Olea Voyages’ maximum financial liability will be limited to three times the total trip price, without prejudice to international conventions applicable to transportation.
8. AIR TRANSPORT
8.1 AIRLINES
Where applicable, Olea Voyages will communicate on your contract the identity of the air carrier(s) likely to operate your flights with information on schedules and any stopovers known at that date. In case of modification after your registration, Olea Voyages undertakes to communicate to you, as soon as it becomes aware and until your departure, all changes in the identity of air carrier(s). In accordance with our obligation, we inform you that the European list of banned airlines can be consulted at https://ec.europa.eu/transport/modes/air/safety/air-ban_fr. Boarding taxes and fees for unused and fully paid tickets are refunded upon request (art L 224-66 Consumer Code).
We specify that:
- Stopover times are determined by airlines according to their flight schedules and may be modified without this constituting grounds for fee-free cancellation;
- In case the airline scheduled to operate your flight is unable to transport you, despite its assistance obligation, Olea Voyages may use another airline to have you travel under comparable transportation conditions;
- Remote check-in procedures (before going to the airport) to obtain the boarding pass (with or without cabin seat selection) are available within the timeframes (number of hours before scheduled flight time) set by each airline according to flights.
8.2 TRANSPORTATION CONDITIONS
The airline’s transportation conditions, particularly the number of bags allowed and their maximum weight without surcharge, are available on the airline’s website or upon request from Olea Voyages. In accordance with international air transport regulations, any airline may modify without notice particularly schedules and/or itinerary as well as departure and destination airports. In case of modifications by the airline, particularly due to technical, climatic, or political incidents external to Olea Voyages, delays or cancellations or strikes external to Olea Voyages, additional stopovers, aircraft changes, route changes, political or climatic events, if the traveler decides to cancel the trip, the cancellation fees referred to in Article 5.3 will be charged.
Olea Voyages will not refund expenses (taxis, hotels, transportation, meals…), as long as the traveler is under the airline’s protection. In case of delay in transportation at departure or return from the trip and/or damage or loss of luggage, boarding denial (overbooking) and/or flight cancellation by the airline, it is each traveler’s responsibility, to enable them to assert their rights vis-à-vis the airline, to keep all original documents (tickets, boarding passes, baggage coupons, or others) and to request from the airline any written justification in case of baggage dispute, boarding denial (overbooking), flight delay or cancellation (hereinafter, “Supporting Documents”). The traveler will send their claim to the airline as soon as possible, given the short deadlines imposed, with a copy of Supporting Documents and keep the originals. Olea Voyages’ Customer Service may, in case of difficulty, intervene with the airline to assist the traveler in claim follow-up.
9. PRE AND POST-ROUTING SERVICES ORGANIZED BY THE CLIENT
Transportation, accommodation, and transfer services you organize yourself before or after the trip contracted with Olea Voyages are not part of the travel contract and remain your entire responsibility.
To limit risks of incompatibility with the booked program, Olea Voyages recommends:
- Favoring transportation tickets modifiable without fees and/or fully refundable;
- Allowing reasonable connection times between your different transfer points (minimum 3 hours for international air connections);
- Anticipating potential delays, modifications, or program cancellations;
- Taking out insurance covering cancellation and modification of your personal services as well as their consequences on the trip subscribed with Olea Voyages.
Olea Voyages disclaims all liability and will not provide any refund concerning:
- Pre or post-routing services you booked that would not be used, for any reason;
- Additional costs, financial losses, or damages resulting from modification, delay, or cancellation of your personal services;
- Consequences of lack of coordination between your personal services and those included in the Olea Voyages contract;
- Costs incurred by late arrival or early departure related to your routing services.
This exclusion applies even in the following cases: unforeseeable event, force majeure, Olea Voyages program modification, act of a third party external to Olea Voyages, or act of the Participant themselves. The Client acknowledges assuming sole responsibility for coordination between their personal routing services and the trip contracted with Olea Voyages. No failure in this coordination, whatever its origin, can engage Olea Voyages’ liability or open right to any compensation or refund.
10. ACCESSIBILITY
Trips designed by Olea Voyages are highly personalized and tailor-made. They allow consideration of services adapted to your personal situation, particularly if you face constraints in moving and/or performing activities related to a leisure trip (transportation, accommodation, excursions…).
When developing your travel project, we invite the Client to communicate any restriction or particularity concerning each Participant. This will enable us to offer you adapted and accessible services in case of reduced mobility.
If your request includes transportation services, particularly air, the concerned participant must identify themselves in advance so we can organize necessary assistance.
11. ADMINISTRATIVE AND HEALTH FORMALITIES
The Client is solely responsible for verifying that each Participant has, before departure, valid travel documents conforming to requirements of the country or countries visited (passport, visa, electronic travel authorization, family booklet, exit authorization for minors, mandatory medical or health certificates, etc.). These verifications must be performed according to each Participant’s personal situation and nationality.
The Client undertakes to communicate this information to all Participants. Olea Voyages disclaims all liability in case of non-compliance with police, customs, or health regulations. Any Participant prevented from traveling for failure to present required documents cannot claim any refund.
Unless otherwise stated, Olea Voyages does not handle administrative and health formalities on behalf of Participants. If Olea Voyages exceptionally takes charge of visa obtainment, the following conditions apply:
- Passports must be submitted to Olea Voyages at least 40 days before departure;
- Obtainment fees are charged according to the rate in effect for the destination concerned;
- Where applicable, the following are added: consular fees, shipping fees, and passport translation fees;
- Any urgent request (less than 15 days before departure) results in additional fees of €50 to €200 depending on urgency level and destination, to which other aforementioned fees are added;
- In case of cancellation or termination of the travel contract, visa obtainment fees and consular fees remain the Client’s responsibility and are refundable neither by Olea Voyages nor by its insurer.
12. TRAVEL DOCUMENTS, DEMATERIALIZED DELIVERY
Contractual documents, confirmations, and travel booklets are delivered electronically.
A paper booklet can be sent to the address indicated by the Client; Olea Voyages is not responsible for delivery delays or failures attributable to the carrier or an incorrect address. The traveler remains solely responsible for the validity of their identity and travel documents, police, health, and customs formalities, including for stopovers and transits, and their medical fitness for selected activities.
13. TRAVELER ASSISTANCE IN DIFFICULTY AND COMPLAINTS
In case of difficulty during the trip, we invite you to contact Olea Voyages, particularly if you notice non-conformity in performance of your trip services, using contact information provided on documents issued by Olea Voyages. Olea Voyages undertakes to provide appropriate assistance as soon as possible.
In case of complaint, account will be taken, where applicable, of your failure to report any non-conformity in service performance during your trip insofar as it could have financial consequences.
After your trip, the Client may address a complaint regarding performance conditions of their trip services by email to contact@oleavoyages.com or by mail to the registered office address.
Failing an amicable solution within two months, the Client may contact the Tourism and Travel Mediator whose contact details are: MTV Médiation Tourisme Voyage – BP 80 303 – 75 823 Paris Cedex 17. You will also find all referral procedures on the website: www.mtv.travel.
14. INSURANCE
Olea Voyages recommends taking out appropriate insurance (cancellation, interruption, assistance-repatriation, medical expenses, luggage, civil liability abroad). Coverage and exclusions appear in notices provided on durable medium by the partner insurer. Absence of insurance cannot justify a refund request from Olea Voyages.
15. ELECTRONIC EVIDENCE, CORRESPONDENCE AND ANTI-FRAUD
Electronic exchanges, validations, signatures, connection logs, IP addresses, receipts, and confirmations constitute admissible evidence between parties. Olea Voyages may request proof of identity or residence in case of suspected fraud and refuse or cancel a booking in the absence of sufficient guarantees, with restitution of uncommitted amounts.
16. PERSONAL DATA (GDPR)
As part of travel contract execution, Olea Voyages, as data controller, collects and processes personal data of the Client and Participants (identity, contact details, travel information). This data is necessary for booking, organizing, and performing the trip, as well as complying with Olea Voyages’ legal obligations. The Client and Participants have rights of access, rectification, erasure, limitation, opposition, and portability regarding their personal data, which they may exercise by contacting Olea Voyages at: contact@oleavoyages.com. To learn all information regarding processing of your personal data (purposes, recipients, retention periods, international transfers, security), please consult our Personal Data Protection Policy accessible on our website www.oleavoyages.com or upon request.
17. INTELLECTUAL PROPERTY AND IMAGE RIGHTS
Content, trademarks, texts, photographs, and videos distributed by Olea Voyages or its partners are protected. Any unauthorized reproduction or use is prohibited. Any image rights transfers granted are subject to a separate agreement.
18. STATUTE OF LIMITATIONS
Subject to special periods for bodily injury, actions based on performance of the package travel contract are time-barred after two years from the triggering event.
19. APPLICABLE LAW, LANGUAGE AND COMPETENT JURISDICTION
The contracts concluded with Olea Voyages and these General Terms and Conditions are subject exclusively to French law. The official French version of the General Terms and Conditions is available at https://oleavoyages.com/fr/conditions-generales-de-vente/.
In the context of our business relationships, we may provide our clients with translations of our General Terms and Conditions and contractual documents in their language for informational purposes and to facilitate their understanding. However, in the event of any discrepancy or interpretation issue, only the French version of the General Terms and Conditions shall be authoritative and legally binding.
All correspondence, notifications, claims, or formal procedures relating to the contract may be written in the language agreed upon by the parties for their convenience. However, the parties acknowledge that French law applies and that the reference legal documents are written in French.
20. FINAL PROVISIONS
The nullity of one provision does not affect the validity of others. Olea Voyages’ failure to assert a right does not constitute waiver. These provisions enter into force on the date appearing in the header and replace any previous version.
STANDARD INFORMATION FORM FOR PACKAGE TRAVEL CONTRACTS
The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the Tourism Code.
You will therefore benefit from all rights granted by the European Union applicable to packages, as transposed into the Tourism Code. The company OLEA VOYAGES will be fully responsible for proper performance of the package as a whole.
Furthermore, as required by law, the company OLEA VOYAGES has protection to refund your payments and, if transportation is included in the package, to ensure your repatriation should it become insolvent.
ESSENTIAL RIGHTS PROVIDED BY DIRECTIVE (EU) 2015/2302 TRANSPOSED INTO THE FRENCH TOURISM CODE
Travelers will receive all essential information about the package before concluding the package travel contract. The organizer and the retailer are responsible for proper performance of all travel services included in the contract.
Travelers receive an emergency telephone number or contact point details allowing them to reach the organizer or retailer. Travelers may transfer their package to another person, subject to reasonable notice and possibly payment of additional fees.
The package price may only be increased if specific costs increase (for example, fuel prices) and if this possibility is explicitly provided in the contract, and cannot in any case be modified less than twenty days before the package start.
If the price increase exceeds 8% of the package price, the traveler may terminate the contract. If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction in case of corresponding cost decreases.
Travelers may terminate the contract without paying termination fees and be fully refunded for payments made if one of the essential elements of the package, other than price, undergoes a significant modification. If, before the package start, the professional responsible for the package cancels it, travelers may obtain refund and compensation, if applicable.
Travelers may terminate the contract without paying termination fees before the package start in case of exceptional circumstances, for example if there are serious safety problems at the destination likely to affect the package.
Furthermore, travelers may, at any time before the package start, terminate the contract subject to payment of appropriate and justifiable termination fees.
If, after the package start, important elements cannot be provided as planned, other appropriate services must be offered to travelers, at no additional cost. Travelers may terminate the contract without paying termination fees when services are not performed in accordance with the contract, this significantly disrupts package performance, and the organizer does not remedy the problem.
Travelers also have right to a price reduction and/or compensation in case of non-performance or poor performance of travel services.
The organizer or retailer must provide assistance if the traveler is in difficulty.
If the organizer or retailer becomes insolvent, amounts paid will be refunded. If the organizer or retailer becomes insolvent after the package start and if transportation is included in the package, travelers’ repatriation is guaranteed.
